Herd

The service

Herd helps you identify yourself on a smart device and reach the contacts you designate. The Service may evolve over time, and features may be added or removed.

Your account

You must be at least 13 years old to use the Service. You are responsible for the accuracy of the information you provide and for all activity under your account. You sign in with a one-time code we send to your phone number or email address; keep access to those secure.

SMS program terms

Program description. Herd uses SMS only for the following:

• Sign-in codes. A one-time verification code, sent to confirm you own a mobile number when you sign up or sign in.
• An introduction to the people you add. When you add someone as one of your people, Herd sends them one text that names you, explains what Herd is and why they are receiving it, and tells them how to opt out.
• Messages you start. When you ask Herd to reach one of your people, Herd texts them on your behalf. The text can include your location if you choose to share it, or tell them a call from Herd is about to follow.
• Account security notices. An occasional text to your own number when something about the security of your account needs your attention.

Message frequency. Message frequency varies and is driven entirely by your actions in the app. You will not receive promotional or marketing messages from the Herd SMS program.

Cost. Message and data rates may apply. Herd does not charge for SMS, but your mobile carrier may.

Opt-in. You opt in to receive SMS by entering your mobile number into a Herd form and tapping the submit button. The form displays a clear consent disclosure above the button before you submit.

Opt-out. You may opt out at any time by replying STOP to any message you receive from us. After you reply STOP, we stop sending you SMS. Reply START to resume.

Help. Reply HELP to any message for support information, or contact support@goherd.app.

Carriers. Carriers are not liable for any delayed or undelivered messages. Herd is supported on major U.S. carriers.

Privacy. Information collected through the SMS program is handled in accordance with our Privacy Policy. SMS opt-in data is not shared with third parties for marketing purposes.

Acceptable use

You agree not to use the Service to violate any law, infringe anyone’s rights, upload content you do not have rights to, or attempt to disrupt or compromise the Service. You agree to designate as contacts only people who have consented to receive messages from you through Herd.

Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind. Herd is not a substitute for emergency services.

Limitation of liability

To the maximum extent permitted by law, Herd and its providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, arising from your use of the Service.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you violate these Terms or use the Service in a way that risks harm to others or to the Service.

Changes

We may update these Terms from time to time. Material changes will be indicated by updating the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
